Rooftop Antenna Site Upgrades

Rooftop cell sites (or rooftop antenna sites) tend to evolve over time. What may start out as several small antennas and a minimal equipment cabinet can, over years, become a complex installation with multiple carriers, significant equipment, and substantial loading on the building structure.

While some buildings are made to support these types of loads, many are not. Of additional concern, many rooftop cell site leases contain verbiage that grant the tenant the right to add equipment without the property owner’s consent, as long as the addition falls within broadly worded “upgrade” provisions.

Rooftop cell sites can be a great source of revenue from a portion of the building that otherwise would not generate income. However, rooftop cell site upgrades should be an opportunity for both landlord and tenant to assess the tenant’s current and proposed equipment, the condition of the rooftop, and whether the lease needs to be modified to reflect new realities.
